About the IDA

The **Indian Divorce Act, 1869 (IDA)** is the principal statute governing dissolution of marriage and related matrimonial causes for Christians in India. It applies where either party to the marriage professes the Christian religion, and covers dissolution of marriage, nullity, judicial separation, restitution of conjugal rights, alimony, custody and related reliefs. The act runs to roughly 65 sections, organised into 14 chapters covering jurisdiction, dissolution of marriage, nullity, judicial separation, protection orders, restitution of conjugal rights, damages and costs, alimony, settlements, custody of children, procedure, re-marriage and miscellaneous provisions, followed by a Schedule of prescribed forms.
