Breach of contract to attend on and supply wants of helpless person

Anyone under a lawful contract to look after or supply the needs of a person who is helpless because of youth, mental illness, disease, or bodily weakness, and who voluntarily omits to do so, is criminally liable. The omission must be voluntary and by someone who was contractually bound. Penalty: up to three months imprisonment, or a fine up to Rs 5,000, or both.

Priya signs a contract to stay with and supply the needs of Meera, an elderly neighbour who cannot care for herself. Priya knowingly stops visiting and does not provide Meera’s food and medicines. Priya can be punished with up to three months imprisonment, or a fine up to Rs 5,000, or both.

Whoever, being bound by a lawful contract to attend on or to supply the wants of any person who, by reason of youth, or of mental illness, or of a disease or bodily weakness, is helpless or incapable of providing for his own safety or of supplying his own wants, voluntarily omits so to do, shall be punished with imprisonment of either description for a term which may extend to three months, or with fine which may extend to five thousand rupees, or with both.
