Rioting

Summary

When an unlawful assembly, or any member of it, uses force or violence to pursue the assembly's shared object, every member of that assembly is guilty of rioting. Rioting is punishable with imprisonment up to two years, or a fine, or both. If the rioters are armed with a deadly weapon or anything likely to cause death, punishment may extend up to five years, or fine, or both.

Example

Priya joins a crowd that smashes a shop’s windows to force the shopkeeper to leave. Even though Priya only stood near the group, because force was used to further the group’s common object she can be held guilty of rioting and face up to two years’ imprisonment, a fine, or both. If someone in the group had a deadly weapon, the punishment could rise to up to five years, a fine, or both.

Enacted text

(1) Whenever force or violence is used by an unlawful assembly, or by any member thereof, in prosecution of the common object of such assembly, every member of such assembly is guilty of the offence of rioting.

(2) Whoever is guilty of rioting, shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both.

(3) Whoever is guilty of rioting, being armed with a deadly weapon or with anything which, used as a weapon of offence, is likely to cause death, shall be punished with imprisonment of either description for a term which may extend to five years, or with fine, or with both.
