Trial of offences under Bharatiya Nyaya Sanhita, 2023 and other laws

AI Assist

Summary

Offences under the Bharatiya Nyaya Sanhita, 2023 must be investigated, inquired into, tried and otherwise dealt with according to the procedures in this Code. Offences under other laws will generally be handled by the same procedures. If any other law in force prescribes a specific manner or place for investigation, inquiry or trial, that special rule prevails.

Example

Ravi is accused of assault under the Bharatiya Nyaya Sanhita. The police will investigate and the court will try the case using the Code's procedures. If the same conduct were charged under another law that sets a special forum or procedure, that other law's rule would apply instead.
