Alteration in allowance
AI Assist
Summary
Magistrate can alter a monthly maintenance or interim maintenance order when there is proof of a change in a party's circumstances. Any increase is capped so the total monthly allowance does not exceed Rs. 500. If a competent civil Court's decision affects the order, the Magistrate must cancel or vary it; orders for a divorced woman can be cancelled if she remarries, receives the divorce settlement, or voluntarily gives up maintenance rights.
Example
Priya had a monthly maintenance order after divorce from Arjun. She remarried Rohan a year later, so the Magistrate cancelled the monthly maintenance order from the date of her remarriage.
