AI Assist

Summary

Either spouse can file a petition in the District Court or the High Court asking the court to declare their marriage null and void. It applies when a husband or wife wants the marriage treated as having never legally existed. If the court grants the petition, the marriage is legally treated as void.

Example

Priya discovers her husband was already married when they married, so she files a petition in the District Court asking that her marriage be declared null and void. If the court grants the petition, the marriage will be treated as never having legally existed.
