Answer to Petition

AI Assist

Summary

Only defenses that would amount to grounds for a suit for judicial separation or for a decree of nullity of marriage may be raised in answer to a petition for restitution of conjugal rights. Any other objections cannot be pleaded in the answer and will not be entertained by the court.

Example

Arjun files a petition for restitution of conjugal rights asking Priya to resume marital life. Priya cannot, in her answer, rely only on the fact that Arjun stopped contributing to household expenses, because failure to pay expenses is not a ground for judicial separation or nullity of marriage, so that plea will not be allowed.

Bare Act

Enacted text

Nothing shall be pleaded in answer to a Petition for restitution of conjugal rights, which would not be ground for a suit for judicial separation or for a decree of nullity of marriage.
