Punishment of offences committed beyond, but which by law may be tried within, India

Summary

When Indian law makes someone liable for an offence committed outside India, they are dealt with under the Indian Penal Code as if the act had been committed within India. In other words, the IPC applies to acts done beyond Indian territory whenever law allows prosecution in India.

Example

Rohan, an Indian citizen working abroad, diverts money from his Indian employer into his foreign account. Because Indian law allows prosecution for that act, Rohan can be tried under the Indian Penal Code in India as if the theft had been committed within India.

Enacted text

Any person liable, by any Indian law, to be tried for an offence committed beyond India shall be dealt with according to the provisions of this Code for any act committed beyond India in the same manner as if such act had been committed within India.
