Abetment in India of offences outside India

If a person in India instigates or assists someone abroad to do an act that would be an offence if done in India, that person is treated as abetting the offence. It applies when the mental or supporting conduct happens in India but the physical act occurs outside India. The person can be prosecuted for abetment under this Sanhita.

Example

Priya in India messages Arjun, who is in country X, urging him to kill a business rival. Arjun carries out the murder abroad. Priya can be held guilty of abetting that murder and prosecuted under this provision.

Bare Act

Enacted text

A person abets an offence within the meaning of this Sanhita who, in India, abets the commission of any act without and beyond India which would constitute an offence if committed in India.

Illustration

A, in India, instigates B, a foreigner in country X, to commit a murder in that country, A is guilty of abetting murder.
