Exclusion of date on which Court is closed

If the period of limitation ends on a day the Court is closed, the Court may take cognizance on the day it reopens. This applies when a filing deadline or limitation falls on a non-working day for the Court. A day counts as closed if the Court remains shut during its normal working hours.

Example

Priya has 30 days to file an appeal but the 30th day falls on a public holiday when the Court is closed. When the Court reopens the next working day, the Court may take cognizance of her appeal.

Where the period of limitation expires on a day when the Court is closed, the Court may take cognizance on the day on which the Court reopens.

Explanation.-A Court shall be deemed to be closed on any day within the meaning of this section, if, during its normal working hours, it remains closed on that day.
