Power of State Government to empower officer in charge to discharge

AI Assist

Summary

The State Government can authorise the jail's officer in charge where a person is confined under the specified provisions to perform some or all duties normally carried out by the Inspector-General of Prisons under the listed provisions. That lets the local jail head exercise those prison-administration powers in place of the Inspector-General. The authorisation may be limited to particular functions.

Example

Priya is confined in the district jail under the relevant provision. The State authorises the jail officer in charge to discharge certain Inspector-General of Prisons functions for her case, so the officer handles those prison-administration decisions instead of the Inspector-General.

Bare Act

Enacted text

The State Government may empower the officer in charge of the jail in which a person is confined under the provisions of section 369 or section 374 to discharge all or any of the functions of the Inspector-General of Prisons under section 376 or section 377.
