Procedure in respect of letter of request

Summary

Central Government handles transmission of any letter of request, summons or warrant received from, or to be sent to, a contracting State under this Chapter. It must forward the document either to the contracting State or to the concerned court in India. The form and manner of transmission are those notified by the Central Government.

Example

Ravi is accused in a foreign case and a foreign court sends a letter of request to India asking for witness testimony. The Central Government receives the letter and, in the form and manner it has notified, forwards it to the concerned court in India.

Enacted text

Every letter of request, summons or warrant, received by the Central Government from, and every letter of request, summons or warrant, to be transmitted to a contracting State under this Chapter shall be transmitted to a contracting State or, as the case may be, sent to the concerned Court in India in such form and in such manner as the Central Government may, by notification, specify in this behalf.
