Consequences of his failing to do so

Summary

If a person ordered to perform an act or to appear and show cause fails to comply, they become liable to the punishment prescribed in section 188 of the Indian Penal Code. The order against them is then made absolute. Non‑compliance therefore attracts penal consequences and confirms the original order.

Example

Priya is ordered by the magistrate to appear and explain why her roadside stall is obstructing traffic. She does not appear on the hearing date. Under this section she becomes liable to punishment under section 188 of the Indian Penal Code and the order is made absolute.

Bare Act

Enacted text

If such person does not perform such act or appear and show cause, he shall be liable to the penalty prescribed in that behalf in section 188 of the Indian Penal Code (45 of 1860,) and the order shall be made absolute.
