Mode of conferring powers

Summary

High Courts or the State Government may, by order, empower particular persons either by name, by virtue of their office, or whole classes by official title when exercising powers under this Code. The empowerment must be made by an order. The order only takes effect from the date it is communicated to the person who is empowered.

Example

Ravi is named by the State Government as authorised to take certain evidence under the Code. When the order reaches Ravi, his authority to act starts from the date he was informed. Until Ravi is communicated the order, he cannot exercise those powers.

(1) In conferring powers under this Code, the High Courts or the State Government, as the case may be, may, by order, empower persons specially by name or in virtue of their offices or classes of officials generally by their official titles.

(2) Every such order shall take effect from the date on which it is communicated to the person so empowered.
