Withdrawal of powers
AI Assist
Summary
High Court or the state Government can withdraw, wholly or partly, any powers they conferred under this Code on any person or on subordinate officers. A Chief Judicial Magistrate or a District Magistrate can also withdraw powers they themselves delegated. After withdrawal, the person or officer no longer has authority to act under those powers until they are re-delegated.
Example
Priya, a Sub-Divisional Magistrate, was given power by the District Magistrate to grant certain licences. After finding procedural lapses the District Magistrate withdrew the delegation. Priya must stop issuing those licences until the District Magistrate re-delegates the power.
