Procedure in respect of letter of request

Summary

Central Government prescribes the form and manner for transmitting letters of request, summons, or warrants between India and contracting States under this Chapter. Any such document received from, or to be sent to, a contracting State must be forwarded to that State or to the concerned court in India in the form and manner notified by the Central Government. It applies whenever a letter of request, summons or warrant is involved.

Ravi is named in a letter of request from a contracting State asking Indian authorities to serve a summons. The Central Government transmits that letter to the contracting State or sends it to the concerned Court in India using the form and procedure it has notified, so the request is handled only in that prescribed way.

Every letter of request, summons or warrant, received by the Central Government from, and every letter of request, summons or warrant, to be transmitted to a contracting State under this Chapter shall be transmitted to a contracting State or, as the case may be, sent to the concerned Court in India in such form and in such manner as the Central Government may, by notification, specify in this behalf.
