Enforcement of decrees and orders

Orders and decrees made under this Act are executed in the same way as ordinary civil court decrees issued by a court in its original civil jurisdiction. That means there is no special enforcement route: the usual civil execution procedures (attachment, sale of property, etc.) apply to orders under this Act.

Example

Priya gets a maintenance decree from the family court under this Act. When her husband refuses to pay, the court enforces the decree using the usual civil execution methods, for example by attaching his salary or selling movable property until the dues are paid.

Enacted text

All decrees and orders made by the court in any proceeding under this Act shall be enforced in the like manner as the decrees and orders of the court made in the exercise of its original civil jurisdiction for the time being in forced.
