Summary
Where a marriage is dissolved or the wife obtains judicial separation, the High Court (or the District Judge on confirmation) can order the husband to secure a lump sum or annual payments for the wife’s life, after considering her fortune, the husband’s ability, and the parties’ conduct. The Court may instead order reasonable monthly or weekly maintenance. If the husband later cannot pay, the Court can discharge, modify, suspend, or revive the order.
Example
Priya obtains a decree dissolving her marriage. The Court orders Karan to secure a lump sum for her maintenance because she has little fortune and he has means, and also sets monthly payments for her support. If Karan later loses his income, the Court may reduce, suspend, or revive those payments.
