Punishment of criminal conspiracy
AI Assist
Summary
When people agree to commit a crime, the punishment depends on how serious the planned offence is. If the conspiracy is to commit an offence punishable with death, imprisonment for life, or rigorous imprisonment for two years or more, and the Code has no separate penalty for the conspiracy, conspirators are punished as if they had abetted the offence. For any other conspiracy the punishment is imprisonment up to six months, or fine, or both.
Example
Priya and Rohan plan to burn a neighbour's shop. Arson in this case carries rigorous imprisonment for three years, so because the conspiracy targets an offence punishable with rigorous imprisonment of two years or more, they can be punished in the same way as if they had abetted the arson.
Bare Act
Enacted text(1) Whoever is a party to a criminal conspiracy to commit an offence punishable with death, imprisonment for life or rigorous imprisonment for a term of two years or upwards, shall, where no express provision is made in this Code for the punishment of such a conspiracy, be punished in the same manner as if he had abetted such offence.
(2) Whoever is a party to a criminal conspiracy other than a criminal conspiracy to commit an offence punishable as aforesaid shall be punished with imprisonment of either description for a term not exceeding six months, or with fine or with both.
