Intentional insult with intent to provoke breach of the peace

Intentionally insulting someone, when you intend or know the insult is likely to provoke them to disturb the public peace or commit another offence, is a punishable offence. It applies where the insult actually gives provocation likely to cause a breach of the public peace or prompt another crime. Penalty can be imprisonment up to two years, or a fine, or both.

Ravi loudly insults his neighbour during an argument hoping to make the neighbour attack him. Since the insult was intended to and likely did provoke a breach of the public peace, Ravi can be punished with up to two years imprisonment, or a fine, or both.

Whoever intentionally insults, and thereby gives provocation to any person, intending or knowing it to be likely that such provocation will cause him to break the public peace, or to commit any other offence, shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both.
