Saving of inherent powers of High Court

High Court retains its inherent power to make orders necessary to give effect to any order under this Sanhita, to prevent abuse of court processes, or to secure the ends of justice. Those powers are not limited by the Sanhita. The Court can therefore issue directions or remedies beyond the literal statute when required.

Priya gets an order under the Sanhita directing a local officer to stop an eviction, but the officer ignores it. She approaches the High Court, which uses its inherent powers to order compliance and to restrain or penalize the officer to prevent abuse of process, thereby enforcing the original order.

Nothing in this Sanhita shall be deemed to limit or affect the inherent powers of the High Court to make such orders as may be necessary to give effect to any order under this Sanhita, or to prevent abuse of the process of any Court or otherwise to secure the ends of justice.
