Declaration by sureties

AI Assist

Summary

Anyone who stands surety for an accused to secure his release on bail must, before the Court, declare how many persons they have stood surety for, including the accused, and give all relevant particulars. This obligation applies when a person signs as surety at the bail hearing or on the bond. The Court thereby gets the information it needs to assess the surety's position.

Example

Priya appears in Court to stand surety for Arjun's bail. She declares she has already stood surety for two other persons and gives their names, addresses and bond details. The Court records these particulars before accepting her as surety.

Bare Act

Enacted text

Every person standing surety to an accused person for his release on bail, shall make a declaration before the Court as to the number of persons to whom he has stood surety including the accused, giving therein all the relevant particulars.
