Summary trial by Magistrate of second class

Summary

High Court may empower any magistrate who has the powers of a second-class Magistrate to try summarily offences that are punishable only with a fine or with imprisonment up to six months, including attempts and abetments. When so empowered, that magistrate can conduct a quicker, simpler trial instead of full formal proceedings.

Ravi is accused of a petty offence punishable only by a fine or up to six months' imprisonment. Because the High Court authorised the local second-class Magistrate to try such cases summarily, the Magistrate held a quick summary trial and imposed either a fine or a short jail term without the regular lengthy trial.

The High Court may confer on any Magistrate invested with the powers of a Magistrate of the second class power to try summarily any offence which is punishable only with fine or with imprisonment for a term not exceeding six months with or without fine, and any abetment of or attempt to commit any such offence.
