Procedure for Summary trials

Summary

When an offence is tried under this Chapter, the court must follow the Sanhita's procedure for trial of a summons-case unless the Chapter specifies otherwise. Any conviction under this Chapter cannot result in imprisonment for more than three months.

Example

Priya runs a small shop and is accused of a minor public nuisance under this Chapter. Her hearing will follow the Sanhita procedure for a summons-case, unless the Chapter gives a different step. If convicted, Priya cannot be sentenced to more than three months' imprisonment.

Enacted text

(1) In trials under this Chapter, the procedure specified in this Sanhita for the trial of summons-case shall be followed except as hereinafter mentioned.

(2) No sentence of imprisonment for a term exceeding three months shall be passed in the case of any conviction under this Chapter.
