Local Jurisdiction of Executive Magistrates
AI Assist
Summary
Under the State Government's control, the District Magistrate can fix local limits inside the district where Executive Magistrates may exercise some or all of their powers. If the District Magistrate prescribes limits, an Executive Magistrate’s authority applies only within those limits. If no limits are prescribed, every Executive Magistrate’s powers extend throughout the whole district.
Example
Priya files an FIR about illegal construction in her village. The District Magistrate has defined local limits, so the Executive Magistrate for that area can take action there but an Executive Magistrate from another part of the district cannot. If no limits were set, any Executive Magistrate in the district could have acted.
Bare Act
Enacted text(1) Subject to the control of the State Government, the District Magistrate may, from time to time, define the local limits of the areas within which the Executive Magistrates may exercise all or any of the powers with which they may be invested under this Code.
(2) Except as otherwise provided by such definition, the jurisdiction and powers of every such Magistrate shall extend throughout the district.
