Concurrent power of Central Government in case of death sentences

AI Assist

Summary

In cases of death sentences, the Central Government may exercise the same powers that the State Government has under sections 432 and 433. That allows the Centre to suspend, remit or commute a death sentence, or to alter related fines or terms of imprisonment. The rule applies only where the punishment imposed is death.

Example

Rohan is convicted and sentenced to death. The Central Government can exercise the State's powers under sections 432 and 433 and commute his death sentence to life imprisonment or alter connected fines or terms of imprisonment.

Bare Act

Enacted text

The powers conferred by sections 432 and 433 upon the State Government may, in the case of sentences of death, also be exercised by the Central Government.
