Saving of inherent power of High Court

AI Assist

Summary

High Court has residual powers beyond the written Code to pass any orders needed to give effect to orders under the Code, to stop abuse of the court process, or to secure the ends of justice. These powers kick in when statutory remedies are inadequate or are being misused. They allow the High Court to frame relief necessary to enforce rights or prevent harassment.

Example

Priya has a court injunction in a criminal matter, but the other side keeps filing fresh procedural objections to delay enforcement. Priya moves the High Court, which uses its inherent power to enforce the injunction and bar further delay as an abuse of process. The original order is made effective again.

Bare Act

Enacted text

Nothing in this Code shall be deemed to limit or affect the inherent powers of the High Court to make such orders as may be necessary to give effect to any order this Code, or to prevent abuse of the process of any Court or otherwise to secure the ends of justice.
