Duty of High Court to exercise continuous superintendence over Courts of Judicial Magistrates

AI Assist

Summary

High Court must continuously supervise the subordinate Courts of Judicial Magistrates to ensure cases are disposed of expeditiously and properly. That supervision allows the High Court to monitor procedure, timetables and case management and correct delays or mismanagement.

Example

Priya's theft case before a Judicial Magistrate has been delayed for many months with no regular hearings. The High Court can use its continuous superintendence to order proper hearing schedules and push the Magistrate to finish the trial quickly.

Bare Act
