Statements of accused not to be used

AI Assist

Summary

When an accused files an application for plea bargaining, any statements or facts given in that application may not be used for any purpose except proceedings under this Chapter. Admissions made to seek plea bargaining are therefore confined to the plea bargaining process and cannot be relied on later in other prosecutions or civil matters.

Example

Priya files a plea bargaining application admitting she took a neighbour's phone to repay a loan. That admission cannot be used later against her in another criminal trial or a civil claim; it can only be used within the plea bargaining proceedings under this Chapter.

Bare Act

Enacted text

Notwithstanding anything contained in any law for the time being in force, the statements or facts stated by an accused in an application for plea bargaining filed under section 265B shall not be used for any other purpose except for the purpose of this Chapter.
