Non-application of the Chapter

AI Assist

Summary

Juveniles and children as defined in clause (k) of section 2 of the Juvenile Justice Act are excluded from this Chapter. When a person falls within that definition, the Chapter's criminal procedures and penalties do not apply. The child is dealt with under the Juvenile Justice Act and the juvenile justice process instead.

Example

Priya, aged 15, is accused of shop theft and brought to the police. Because she is a child as defined in clause (k) of section 2 of the Juvenile Justice Act, the Chapter's criminal procedures and punishments are not used. Her case is handled under the Juvenile Justice Act and juvenile justice authorities take charge.

Bare Act

Enacted text

Nothing in this Chapter shall apply to any juvenile or child as defined in clause (k) of section 2 of the Juvenile Justice (Care and Protection of Children) Act, 2000 (56 of 2000).”
