Direction for grant of bail to person apprehending arrest

AI Assist

Summary

Anyone who reasonably expects arrest for a non-bailable offence can apply to the High Court or Court of Session for anticipatory bail. The court may refuse or grant interim bail after considering seriousness, antecedents, flight risk and whether the accusation is meant to humiliate, and it can add conditions (availability for questioning, no tampering with witnesses, no leaving India). If arrested without warrant while covered by the order and able to give bail, the person must be released. Certain specified sexual offences are excluded.

Example

Priya fears arrest for an alleged non-bailable theft and applies to the Court of Session for anticipatory bail. The court grants an interim order saying she must be available for questioning and not leave India, and it sends a seven-day notice to the Public Prosecutor and Superintendent of Police. When Priya is later arrested without warrant she furnishes bail and is released, and must appear for the final hearing.
