Power of Additional Sessions Judge

AI Assist

Summary

An Additional Sessions Judge may exercise all the powers of a Sessions Judge under this Chapter when a Sessions Judge transfers a case to them by general or special order. This applies only to cases transferred under such an order. The result is that the Additional Sessions Judge will conduct the trial and pass orders with the same authority as the Sessions Judge.

Example

Priya files an FIR for theft and the Sessions Judge transfers her case to an Additional Sessions Judge by general order. The Additional Sessions Judge can exercise all the powers of the Sessions Judge, so they can frame charges, take evidence and pass judgment in that case.
