Summary trial by Magistrate of the second class

Summary

High Court can empower a Magistrate of the second class to try, by summary procedure, offences that are punishable only with a fine or with imprisonment for up to six months, including attempts or abetments. When this power is exercised, such cases are dealt with faster in a summary trial rather than a full trial.

Example

Ravi is accused of breaking a shop sign in a small neighbourhood dispute; the offence carries only a fine or up to six months' jail. Because the High Court has given summary power to the second class Magistrate, Ravi can be tried quickly in a summary proceeding instead of a full trial.

The High Court may confer on any Magistrate invested with the powers of a Magistrate of the second class power to try summarily any offence which is punishable only with fine or with imprisonment for a term not exceeding six months with or without fine, and any abetment of or attempt to commit any such offence.
