Procedure for summary trials

Summary

Trials under this Chapter are to follow the Code's procedure for summons-case trials, subject to any specific modifications here. The court must use the summons-case process for conduct of the trial unless otherwise provided. No conviction under this Chapter may result in imprisonment for more than three months, though fines or shorter sentences are allowed.

Example

Priya is accused of a minor neighbourhood disturbance and her case is tried under this Chapter. The magistrate follows the summons-case procedure in conducting the trial, and if Priya is convicted the court cannot sentence her to more than three months imprisonment, though it may impose a fine or a shorter term.

Enacted text

(1) In trial under this Chapter, the procedure specified in this Code for the trial of summons-case shall be followed except as hereinafter mentioned.

(2) No sentence of imprisonment for a term exceeding three months shall be passed in the case of any conviction under this Chapter.
