Abetment of desertion of soldier, sailor or airman

Summary

Encouraging, helping or otherwise abetting a serving officer, soldier, sailor or airman to desert their duty is an offence. If someone abets desertion in the Army, Navy or Air Force of the Government of India, they can be punished with up to two years imprisonment, or a fine, or both.

Ravi arranges transport and persuades a soldier to leave his post without permission; the soldier deserts. Ravi can be prosecuted and, if convicted, can receive up to two years imprisonment, or a fine, or both under this provision.

Whoever, abets the desertion of any officer, soldier, sailor or airman, in the Army, Navy or Air Force of the Government of India, shall be punished with imprisonment of either description for a term which may extend to two years, or with fine, or with both.
