Bar on jurisdiction of Civil Courts
AI Assist
Summary
Where a Claims Tribunal exists for an area, Civil Court has no jurisdiction over any question about a compensation claim that the Tribunal can decide. Civil Courts also cannot grant an injunction to stop or interfere with actions taken or to be taken in or before the Claims Tribunal on such compensation claims.
Example
Priya's scooter was damaged in a road accident, so she files a claim for compensation at the local Claims Tribunal. She cannot ask a Civil Court to decide the same compensation issue, and the Civil Court cannot grant an injunction to stop the Tribunal from hearing or deciding her claim.
Bare Act
Enacted textWhere any Claims Tribunal has been constituted for any area, no Civil Court shall have jurisdiction to entertain any question relating to any claim for compensation which may be adjudicated upon by the Claims Tribunal for that area, and no injunction in respect of any action taken or to be taken by or before the Claims Tribunal in respect of the claim for compensation shall be granted by the Civil Court.
