Summary

When a person can claim compensation under two different provisions for the same motor-accident loss, they must pick one and file only that claim. They cannot file duplicate claims under both provisions; the claim will be processed only under the provision chosen by the claimant.

Example

Rohan, a shopkeeper, is injured when a speeding car hits his shop and he qualifies for compensation under two different provisions for the same injury. He must file his claim under one of those provisions only; he cannot file separate claims under both, and the claim will be decided on the basis he chooses.

Bare Act

Enacted text

Where a person is entitled to claim compensation under section 140 and section 163A, he shall file the claim under either of the said sections and not under both.
