Applicability of Chapter to certain claims under Act 8 of 1923
AI Assist
Summary
If death or permanent disablement results from a motor accident of the kind covered earlier in this Act, the rules in this Chapter also govern any claim for compensation under the Workmen’s Compensation Act, 1923. Those Chapter provisions apply with necessary modifications and are treated as part of the Workmen’s Compensation Act for such claims. Consequence: the Chapter’s procedures and standards will control how liability and compensation are decided.
Example
Karan is a delivery worker who becomes permanently disabled when his company van meets with a road accident while he is on duty. When his employer files a claim under the Workmen’s Compensation Act, the Chapter’s provisions will apply to that claim with necessary modifications and be treated as part of the Workmen’s Compensation Act for deciding compensation.
Bare Act
Enacted textThe provisions of this Chapter shall also apply in relation to any claim for compensation in respect of death or permanent disablement of any person under the Workmen’s Compensation Act, 1923 (8 of 1923) resulting from an accident of the nature referred to in sub-section (1) of section 140 and for this purpose, the said provisions shall, with necessary modifications, be deemed to form part of that Act.
