Subordination of Executive Magistrates
AI Assist
Summary
All Executive Magistrates are subordinate to the District Magistrate. An Executive Magistrate exercising powers in a sub-division (other than the Sub-divisional Magistrate) is also subordinate to the Sub-divisional Magistrate, subject to the District Magistrate's general control. The District Magistrate may make rules or give special orders about allocating work among subordinate Executive Magistrates, consistent with the Sanhita.
Example
Ravi is posted as an Executive Magistrate in a sub-division. If his Sub-divisional Magistrate gives a direction during a local dispute, Ravi must follow it; if the District Magistrate later issues rules reallocating cases among magistrates, Ravi must follow those rules too.
