Service on Government servant

Summary

If the person summoned is in active government service, the court will normally send two copies of the summons to the head of that office. The head must arrange service in the prescribed manner and return a signed copy to the court. That signature serves as evidence that the summons was duly served.

Example

Priya is a teacher in a government school and a court issues a summons for her. The court sends duplicate summons to the school principal, who gets it served as required and returns a signed copy to the court. The principal's signature is treated as proof that Priya was served.

Enacted text

(1) Where the person summoned is in the active service of the Government, the Court issuing the summons shall ordinarily send it in duplicate to the head of the office in which such person is employed; and such head shall thereupon cause the summons to be served in the manner provided by section 62, and shall return it to the Court under his signature with the endorsement required by that section.

(2) Such signature shall be evidence of due service.
