Magistrate may direct search in his presence

AI Assist

Summary

A magistrate can order that a place be searched in his presence whenever he is competent to issue a search warrant for that place. The magistrate then personally supervises the search to ensure proper procedure. This power applies only to places for which he could lawfully issue a warrant.

Example

Rohan runs a small shop and police suspect stolen goods there. They ask the magistrate for action; the magistrate, being competent to issue a warrant, directs the search to be made in his presence. The magistrate attends and supervises the search and seizure.
