Act of a child under seven years of age

A child under seven years cannot be guilty of any offence. When the person who did the act was under seven at the time, the act is treated as not an offence. Consequence: no criminal liability; the child cannot be tried or punished for that act.

Priya, aged six, takes a neighbour's bicycle for a short ride without permission. Because she is under seven, that act is not an offence and she cannot be prosecuted or punished under criminal law.
