Composition of certain offences
AI Assist
Summary
Certain traffic offences listed in the Act can be compounded by officers or authorities the State Government specifies by notification in the Official Gazette. Compounding can take place before or after prosecution and usually involves payment of a prescribed amount. If an offence is compounded, the offender (if in custody) is discharged and no further proceedings are taken for that offence.
Example
Rohan is accused of a minor traffic offence under the Act and formal prosecution is started. The State has notified that local motor vehicle inspectors can compound such offences for a set amount. Rohan pays the prescribed sum, the offence is compounded, he is released from custody and no further proceedings follow.
