Section15
Act of Judge when acting judicially
AI Assist
Summary
An act done by a judge while performing judicial duties is not an offence. It applies when the judge uses powers that the law gives, or honestly believes he has. The protection covers actions taken in good faith while adjudicating a case.
Example
Judge Arjun hears a neighbour dispute and orders Ravi to vacate a flat after holding a hearing. Arjun honestly believes the law permits that order and issues it while acting judicially. Even if the order is later set aside, Arjun’s act is not an offence under this rule.
Bare Act
Enacted textNothing is an offence which is done by a Judge when acting judicially in the exercise of any power which is, or which in good faith he believes to be, given to him by law.
