Power to order costs

Summary

When a court hears an application to file a complaint under section 379 or an appeal under section 380, it may require payment of costs it considers just. The power applies whenever such an application or appeal is before the court. The court can order one party to pay the other’s legal or procedural expenses as a fair consequence.

Example

Priya asks a court for permission to file a complaint under section 379 against a neighbour. If the court finds her claim weak or thinks costs are warranted, it can order Priya to pay the neighbour’s legal or other costs.

Any Court dealing with an application made to it for filing a complaint under section 379 or an appeal under section 380, shall have power to make such order as to costs as may be just.
