Question by party to his own witness
AI Assist
Summary
The court may, at its discretion, allow a party who calls a witness to ask that witness any question an opposing party could ask in cross-examination. This permission is not automatic; the court decides whether to allow it. Even if the party is allowed to ask such questions, it may still rely on any part of the witness's evidence.
Example
Priya calls her neighbour as a witness in a property dispute. The defence has raised points that need testing, so the court allows Priya to ask the neighbour the same cross-examination-style questions to probe inconsistencies. After that questioning, Priya can still rely on any part of the neighbour's testimony that helps her case.
Bare Act
Enacted text(1) The Court may, in its discretion, permit the person who calls a witness to put any question to him which might be put in cross-examination by the adverse party.
(2) Nothing in this section shall disentitle the person so permitted under sub-section (1), to rely on any part of the evidence of such witness.
