Violation of condition of remission of punishment
AI Assist
Summary
If a person accepts a conditional remission of punishment and then knowingly violates any condition, they can be required to undergo the original punishment. If they have not yet undergone any part of that punishment, they must suffer the whole original sentence. If they have already undergone some part, they must undergo only the remaining part.
Example
Ravi is released early under a conditional remission that requires weekly reporting to a probation officer. He knowingly stops reporting and leaves the state, breaching the condition. Since he accepted the remission and violated it, if he had not served any part of his original sentence he will now have to undergo the full original punishment; if he had served part, he must serve the remainder.
Bare Act
Enacted textWhoever, having accepted any conditional remission of punishment, knowingly violates any condition on which such remission was granted, shall be punished with the punishment to which he was originally sentenced, if he has already suffered no part of that punishment, and if he has suffered any part of that punishment, then with so much of that punishment as he has not already suffered.
