Punishment for rape 1

AI Assist

Summary

Rape carries rigorous imprisonment for not less than ten years and a fine, and may extend to life imprisonment. Aggravated situations — for example rape by a police officer or public servant in custody, in institutions, by someone in a position of trust or control, on a pregnant or disabled woman, during communal violence, causing grievous harm, or repeated offences — attract higher punishment of ten years to life and a fine. Rape of a girl under sixteen attracts not less than twenty years to life, plus a fine that must reasonably meet the victim’s medical and rehabilitation expenses and be paid to her.

Example

Meera is held at her local police station after a complaint. A police officer of that station rapes her. That officer faces rigorous imprisonment for at least ten years up to life and a fine, and the punishment for such custodial rape is among the aggravated offences with higher minimums.
