False statement in connection with an election

Making or publishing a false factual statement about a candidate's personal character or conduct to influence the result of an election is an offence. It applies when the maker knows the statement is false, believes it to be false, or does not believe it to be true. The person can be punished with a fine.

Example

Rohan circulates leaflets saying Arjun embezzled funds to make voters turn against him. Rohan knew the claim was false but published it to affect the election result. Rohan can be punished with a fine under this rule.

Enacted text

Whoever with intent to affect the result of an election makes or publishes any statement purporting to be a statement of fact which is false and which he either knows or believes to be false or does not believe to be true, in relation to the personal character or conduct of any candidate shall be punished with fine.
