Illegal payments in connection with an election

Summary

Payments to promote a candidate at a public meeting, by advertisement, circular or any other method are illegal if made without the candidate's general or special written authority. The offender may be fined up to five hundred rupees. However, an unauthorised expense of ten rupees or less will be treated as authorised if the candidate gives written approval within ten days of the expense.

Example

Ravi pays for posters and an advertisement to promote a candidate without getting the candidate's written permission; he may be fined up to Rs 500. If instead Ravi had spent only Rs 8 and obtained the candidate's written approval within ten days, that expense would be treated as authorised.

Enacted text

Whoever without the general or special authority in writing of a candidate incurs or authorizes expenses on account of the holding of any public meeting, or upon any advertisement, circular or publication, or in any other way whatsoever for the purpose of promoting or procuring the election of such candidate, shall be punished with fine which may extend to five hundred rupees;

Provided that if any person having incurred any such expenses not exceeding the amount of ten rupees without authority obtains within ten days from the date on which such expenses were incurred the approval in writing of the candidate, he shall be deemed to have incurred such expenses with the authority of the candidate.
